Enduring Power of Attorney

An Enduring Power of Attorney allows you to appoint a person of your choice to manage your assets and financial affairs if you are unable to do so due to illness, an accident or in your absence, it is done via a legal document.

Once you have created and signed the Enduring Power of Attorney, when signing a sales agency on someone’s behalf, you will need to have also registered the Enduring Power of Attorney with the Lands Title Office. This can be done in person or through your conveyancer.

Enduring Power of Guardianship

An Enduring Power of Guardianship is a person you choose to appoint to make personal, lifestyle and treatment decisions on your behalf in the care you are unable or lose the ability to make these decisions for yourself, this can be due to an illness or injury.

An Enduring Power of Guardianship cannot make property and financial decisions. You will need to appoint an Enduring Power of Attorney.

Executor of Estate

An Executor is assigned to making sure a person’s last wishes are granted including the disposition of their property and possessions. An Executor of a will is responsible for ensuring any debts and creditors left by the deceased are paid off, and any money or property remaining is shared according to their wishes.

Wills

A Will is a document that states how you would like your assets to be distributed when you die, and the person or organisation you would like to be responsible for carrying out your wishes.

Advance Care Directive

The Advance Care Directive allows you to make legal preparations for your future health care, end of life, preferred living arrangements and other personal matters. The Advance Care Directive allows you to:

  • Write down your wishes, preferences and instructions for your future health care, end of life, living arrangements, personal matters and/or
  • Appoint one or more Substitute Decision-Makers to make these decisions on your behalf if you are unable to do so in the future.
